3 Count: Sovereign Immunity

Have any suggestions for the 3 Count? Let me know via Twitter @plagiarismtoday.

1: Hanafin has No Plan for Copyright Legislation

First off today, Ireland’s Minister for Enterprise, Mary Hanafin, announced today that she has no plans to push through or approve copyright legislation this session, including a controversial bill that would have allowed judges to grant injunctions against ISPs to block file sharers. The legislation, which was rumored by former Minister for Communication Eamon Ryan to be on Hanafin’s desk awaiting signature, it seems, does not exist or will not be signed. This means that Ireland will not be seeing another three strikes bill, at least not until the next government takes power.

2: Court Drops FileSoup BitTorrent Case, Administrators Walk Free

Next up today, in the UK prosecutors have dropped a case against two administrators for the bittorrent site FileSoup after they were unable to formulate their charges. The prosecutors struggled with various aspects of the case, including the technology behind Bittorrent and whether to charge FileSoup as a company or as individuals, This comes as a setback to the Federation Against Copyright Theft (FACT), which invested significant amounts of money into the case and was the driving force behind the prosecution.

3: Ga. Board of Regents Wins Copyright Ruling

Finally today, the 11th Circuit Court of Appeals ruled that National Association of Boards of Pharmacy (NABP) can not pursue litigation against the Georgia Board of Regents due to sovereign immunity issues, The lawsuit stemmed from a University of Georgia professor, who the NABP claimed took questions from their licensing exam and distributed them to students. The case against the professor, Flynn Warren Jr., is still pending.
