It is Friday again and that means that it is time for another episode of the Copyright 2.0 Show.

With the holidays upon us in full force, it might seem like copyright news would be slowing down and there’d be less to talk about. However, we’d also be wrong. Not only do we have a major non-ruling from the Supreme Court but a major Appeals Court ruling as well. We also have an “Anonymous” arrest in the Netherlands and much, much more.

This week’s stories include:

SCOTUS Rules on Costco Case, Says Nothing

Appeals Court Upholds Ban on World of Warcraft Bot

Anonymous’ IRC Operator Arrested

George Clinton Sues the Black Eyed Peas

The latest news on the World of Warcraft Glider lawsuit, Global Gaming Factory and a copyright lawsuit millions of years in the making.

Have any suggestions for the 3 Count? Let me know via Twitter @plagiarismtoday.

1: Court Upholds Ban on World of Warcraft Bot

First off today, the Ninth Circuit Court of Appeals has upheld a lower court decision declaring the “Glider” bot to be a copyright infringement of Blizzard Entertainment’s World of Warcraft. The bot performs mundane tasks for players, such as killing enemies and collecting gold, while the player is away. The lower court had ruled the bot was infringing since it violated the game’s terms of service but that part of the ruling was tossed out. However, the Appeals Court upheld that it did unlawfully circumvent protections placed into Word of Warcraft, making it a violation of the DMCA. However, Glider’s maker, Michael Donnelly, claimed that the bot doesn’t circumvent, only avoids detection, and he may take the matter to the Supreme Court. The court also ruled that the lower court needs to reevaluate the $6.5 million it said Donnelly owed Blizzard.

2: Failed Pirate Bay Buyout Blamed for Global Gaming Factory Going Bust, Again

Next up today, Global Gaming Factory, the Swedish company that has attempted to buy The Pirate Bay and other bittorrent services on multiple occasions, may be headed for bankruptcy. Two of the company’s debtors, claiming that they are owed about 1.5 million kronor ($220,000) are asking a court to put GGF into bankruptcy so they can begin collecting what they can on their debts. Despite the setbacks, GGF owner Hans Pandeya has vigorously pursued the purchase of a bittorrent site, allegedly sending out offers as late as September.

3: Dinosaur bones prompt federal lawsuit in Montana

Finally today, a copyright lawsuit millions of years in the making. According to a recent filing in Montana, The Black Hills Institute of Geological Research. is suing Fort Peck Paleontology claiming that they failed to return castings made of bones from two famous tyrannosaurus rex skeletons, dubbed Stan and Sue, and are selling unauthorized copies of the castings. The Black Hills institute is seeking some $8.2 million in damages and admits that this lawsuit is the first of its kind.

Suggestions

That’s it for the three count today. We will be back tomorrow with three more copyright links. If you have a link that you want to suggest a link for the column or have any proposals to make it better. Feel free to leave a comment or send me an email. I hope to hear from you.

Have any suggestions for the 3 Count? Let me know via Twitter @plagiarismtoday.

1: Massive Judgment In World of Warcraft Copyright Infringement Case

First off today, Blizzard, the company behind the popular World of Warcraft roleplaying game, won a major judgment against Scapegaming, a company that Blizzard said was running an unauthorized World of Warcraft server. The judge in the case seemed to agree, awarding Blizzard, over $3 million in profits, a bit over $65,000 in attorney fees and $85 million in statutory damages. Scapegaming did not defend the lawsuit, which may indicate collecting the damages will prove nearly impossible.

2: Radio, RIAA: Mandatory FM Radio in Cell Phones is the Future

Next up today, though the RIAA and the National Association of Broadcasters may not agree on whether radio stations should pay royalties to labels, they are both backing a plan to require the installation of FM chips in all cell phones and other handheld electronic devices. According to the organizations, this gives consumers more legitimate choices for listening to music and aids in public safety as emergency broadcasts are sent out over FM frequencies. The Consumer Electronic Association, which represents manufacturers of such devices, opposed the idea.

3: AP Decides Not to LOL

Finally today, the Associated Press, apparently was in negotiations with Pet Holdings Inc. the owners of the I Can Has Cheezburger blog network, to bring the network into their fold. Negotiations supposedly began to break down after Ben Huh, the owner of Pet Holdings, had issues with the wording in the contract and the AP finally walked away after stating concerns about its integrity. Digital deals are becoming more common for the AP, including Yahoo, Google and the Huffington Post among others.

It was another wild week for copyright news but, fortunately, Chris and I join forces once again to get through this and try to make sense of everything that is going on.

It is Monday again and that means that it is time for another episode of the Copyright 2.0 Show.

This week, something amazing happens as we both Chris and I are on the podcast. We’re even talking at the same time!

However, it was a good week to get back together as we had a lot of “hard” news to go over including updates on the Universal Music lawsuit, the YouTube/Viacom case and a series of rulings on everything from Unixware to Bratz Dolls.

All in all, there were sixteen stories this week including news from all over the copyright world including our “Weird Story of the Week”.

This week’s stories include:

Universal Claims DMCA Notices can Ignore Fair Use

YouTube and Viacom Work to Protect Privacy

SCO Has to Pay Big

Violating a EULA Becomes a Copyright Infringement

Leecher Disputes Movie Industry Claims

And Many more…
