<h4>1: <a href="https://torrentfreak.com/google-gets-involved-in-bittorrent-search-engine-lawsuit-110220/">Google Gets Involved in BitTorrent Search Engine Lawsuit</a></h4>
<p>First off today, Google has filed an amicus brief in the ISOHunt case, which is on appeal after the MPAA won in the district court against the Bittorrent tracker, claiming that the district court was right to rule against ISOHunt, but that it did so for the wrong reasons. According to Google, the lower court&#8217;s finding that ISOHunt was not eligible for safe harbor protection as it had ignored warnings that there was infringing material. However, Google worries that such a ruling could impact their business and, instead, believes that ISOHunt is liable because it induced copyright infringement, not because it ignored warnings. Google had sought permission from both sides to file the brief but the MPAA declined, though the court permitted the filing over their objections.</p>
<h4>2: <a href="http://www.h-online.com/open/news/item/Google-must-continue-to-fight-Oracle-s-copyright-claims-1194838.html">Google Must Continue to Fight Oracle&#8217;s Copyright Claims</a></h4>
<p>Next up today, Google&#8217;s ongoing lawsuit with Oracle, which has Oracle accusing Google of inappropriately using JAVA code in Google&#8217;s Android operating system, must continue as the judge in the case denied Google&#8217;s request for a summary judgement. The judge said that there was not enough evidence for granting such a judgment at this time but denied it without prejudice, meaning that Google will be able to refile after discovery has been completed and additional evidence has been found.</p>
<h4>3: <a href="https://torrentfreak.com/brein-uses-court-win-as-leverage-to-wipe-out-usenet-sites-110221/">BREIN Uses Court Win As Leverage To Wipe Out Usenet Sites</a></h4>
<p>Finally today, the Dutch anti-piracy group BREIN has used its recent court victory over the Usenet site FTD to shut down another 11 such sites, these with a combined total of 900,000 members. BREIN, which won its case against FTD earlier this month, has been busy using the ruling to pressure other sites into closure and, according to their announcement, has been successful. However, there are significant questions about the applicability of the FTD ruling to these cases, which found FTD to be infringing because 13 members of the site also uploaded content to Usenet, and not merely point to it as the site was designed for.</p>

<h4>1: <a href="http://www.wired.com/threatlevel/2010/06/isohunt-not-dead-yet">Isohunt Not Dead Yet, Attorney Says</a></h4>
<p>Bittorrent search engine ISOHunt is making a last-ditch effort to avoid an injunction filed and approved against it. According to attorneys working for the site, the injunction, granted by the judge and requested by the MPAA, is overly broad in that it requires the site to block searches for specific movie titles. ISOHunt claims that this is a violation of their free speech rights in that not all uses of the title are going to be infringing. The judge has tried to clarify the injunction saying it only applies to works owned by the plaintiffs in the case.</p>
<h4>2: <a href="http://blogs.citypages.com/blotter/2010/06/neil_gaiman_fig.php">Neil Gaiman fights Todd McFarlane over Spawn Characters</a></h4>
<p>Next up today, in a story that has my geek senses tingling, author Neil Gaiman and comic artist Todd McFarlane are in a copyright spat over two characters that are a part of the Spawn series. McFarlane, who created Spawn, asked Gaiman to guest author a comic where he created two characters, &#8220;Medieval Spawn&#8221; and &#8220;Angela&#8221; a woman who hunted Spawn. Normally such creations would be a work for hire but Image comics, the publisher of Spawn, is founded on the principle of creator&#8217;s rights and doesn&#8217;t use such contracts. As a result, Gaiman owned the creations prompting McFarlane, according to Gaiman, to create knock offs for use in later books. This dispute is ongoing at the same time as a related spat between the two over the graphic novel Miracleman, which has been halted pending this copyright litigation.</p>
<h4>3: <a href="http://www.billboard.com/news/coldplay-allows-glee-to-use-its-songs-1004098075.story#/news/coldplay-allows-glee-to-use-its-songs-1004098075.story">Coldplay Allows &#8216;Glee&#8217; To Use Its Songs</a></h4>
<p>Finally today, in something of a follow-up to the previous story on Glee and copyright, the group Radiohead, which had originally resisted the shows requests to allow their music to be used has reversed their previous decision and has opened up their entire back catalog to the series. According to the show&#8217;s producers, Radiohead and Bryan Adams were the only rejections they had received.</p>

<h4>1: <a href="http://www.irishtimes.com/newspaper/frontpage/2010/0524/1224271013389.html">Eircom to Cut Broadband Over Illegal Downloads</a></h4>
<p>First off today, Eircom&#8217;s Ireland&#8217;s largest ISP, has initiated a trial period where it will engage in a graduated response, or three strikes system. The ISP, which has some 750,000 subscribers, will process some 50 IP addresses per week on behalf of the Irish Recorded Music Association and will disconnect alleged file sharers for a year after they have received three warnings. Competitor UPC has still resisted such efforts and has a court case on the subject next month.</p>
<h4>2: <a href="http://newteevee.com/2010/05/21/u-s-court-isohunt-has-to-shut-down/">U.S. Court: Isohunt Has to Shut Down</a></h4>
<p>Next up today, in the ISOHunt case, a permanent injunction has been issued that bars the torrent search engine from providing access to almost any and all Hollywood movies. The injunction is likely to force ISOHunt to shut down in the U.S., blocking visitors from within the country. The judge also found that ISOHunt&#8217;s &#8220;lite&#8221; interface, which was designed to mirror Google in appearance, was not enough and was merely a new look on the same results. </p>
<h4>3: <a href="http://www.1up.com/do/newsStory?cId=3179430&#038;cmpid=0101">Sony Believes Piracy is the PSP&#8217;s Biggest Problem</a></h4>
<p>Finally today, according to Sony, its beleaguered PSP handheld gaming system is struggling largely due to piracy, which the company says is &#8220;killing&#8221; the platform. According to the company, the piracy issue is worse in Japan but that is causing many publishers to not offer full support for their products in North America. Sony is introducing new copy protection techniques to reduce or slow down piracy, in hopes of rectifying this issue. </p>

<h4>1: <a href="http://mashable.com/2010/04/06/isohunt-lite/">Isohunt Goes Lite for Visitors From the U.S.</a></h4>
<p>First off today, bittorrent search engine Isohunt has released a &#8220;lite&#8221; version of its site for U.S. visitors. This version is designed to make the site look and function more like Google or other search engines and is a direct response to a U.S. court order demanding that the site pull down infringing results from the service. </p>
<h4>2: <a href="http://www.washingtonexaminer.com/nation/nyc-judge-orders-disclosure-of-those-who-deleted-or-destroyed-records-in-hope-artist-case-89950517.html">NYC Judge Orders Disclosure of Those Who Deleted or Destroyed Records in &#8216;HOPE&#8217; Artist Case</a></h4>
<p>Next up today, the judge in the Shepard Fairey case has ordered his attorneys to turn over records and information on anyone who participated in falsifying or destroying evidence related to the case. This comes after the artist who created the Obama &#8220;Hope&#8221; poster admitted to having falsified evidence to make it seem his poster was based on a different image, thus strengthening his fair use case. This evidence tampering is already the subject of a separate criminal investigation and according to the AP, who is suing him over the poster, it has made the discovery process &#8220;burdensome&#8221;.</p>
<h4>3: <a href="http://www.thewrap.com/article/judge-knocks-down-750m-copyright-lawsuit-against-marvel-and-stan-lee-15980">Judge Rejects $750M Copyright Lawsuit Against Marvel and Stan Lee</a></h4>
<p>Finally today, investors in a failed venture entitled &#8220;Stan Lee Media&#8221; have failed in their suit to obtain copyright interest in several of Stan Lee&#8217;s creations, which are owned by Stan Lee himself and Marvel Comics. The investors had claimed they were owed royalties for their use in print and elsewhere but the judge dismissed their suit, citing a statute of limitations issue with it. </p>

<p>First off today, the Bittorrent search engine ISOHunt may be forced to close as its legal battles against the MPAA have come to a head. The site has been ordered by a judge to remove all infringing torrent files from the service. ISOHunt had argued it was just another search engine, much like Google, but plaintiff attorneys showed evidence that the site had targeted infringing material for indexing. Since it would be almost impossible for ISOHunt to remove all infringing torrents from its index, it seems unlikely that the site will be able to comply with the injunction without closing its doors.</p>
<h4>2: <a href="http://www.nytimes.com/2010/04/01/world/europe/01briefs-Francebrief.html">France: More Publishers Sue Google</a></h4>
<p>Next up today, according to the New York Times, more publishers in France are preparing to sue Google over its book scanning project. This follows a similar suit by the publishing group La Martinière, which won in the lower court though the case is on appeal. According to the publishers, Google has continued scanning their books even after being asked to stop, paving the way for legal action.</p>
<h4>3: Opposition Mounts to UK&#8217;s Digital Economy Bill</h4>
<p>Finally today, opposition is mounting to the Digital Economy Bill in the UK even as the bill seems to be heading for a quick passage in Parliament. The controversial bill, which is due for its second reading in the House of Commons shortly, has had many of its most divisive elements removed, including an amendment that would have given ministers the right to alter copyright law without Parliament&#8217;s oversight, but others, including a provision to disconnect repeat file sharers, remains in the bill.</p>
